RATIFICATION OF WARRANT REGISTER FOR THE PERIOD FROM AUGUST 5, 2022 TO SEPTEMBER 2, 2022. (0300-25)

• Recommendation:

  Staff is requesting that the City Council ratify and file the Warrant Register Report.

RECEIVE TREASURER’S REPORT FOR JULY 2022. (0300-90)

• Recommendation:

  Staff recommends that the City Council receive and file the July 2022 Treasurer's Report.

SECOND READING AND ADOPTION OF ORDINANCE 2022-1217, AMENDING CHAPTER 3.06.020 OF THE MUNICIPAL CODE, RELATING TO THE UNIFORM PUBLIC CONSTRUCTION COST ACCOUNTING ACT LIMITS (0300-95)

• Recommendation:

  Conduct the second reading, waive further reading and adopt Ordinance No. 2022-1217.

RESOLUTION 2022-69 CONTINUING THE PROCLAMATION OF A STATE OF LOCAL EMERGENCY RELATING TO IMPACTS FROM CROSS-BORDER POLLUTION IN THE TIJUANA RIVER. (0150-40 & 0210-26)

• Recommendation:

  Adopt Resolution No. 2022-69 to maintain a state of local emergency related to the cross-border pollution impacts from the Tijuana River and authorize the City Manager, Mayor, and Council members to work with local, State, Federal, and Mexican authorities to advance binational projects to improve conditions in the Tijuana River.

RESOLUTION NO. 2022-71 REVISING AN AGREEMENT BETWEEN THE CITY OF IMPERIAL BEACH AND AZTEC LANDSCAPING, INC. (0940-10)

• Recommendation:

  Adopt Resolution No. 2022-71 to increase the not to exceed agreement with Aztec Landscaping to $175,000.

RESOLUTION 2022-75 TO ACCEPT AND APPROPRIATE $812,262 IN CLEAN CALIFORNIA LOCAL GRANT FUNDS FOR THE 10TH STREETSCAPE ENHANCEMENTS PROJECT (S22107) PER GRANT APPLICATION AMENDMENT A2. (0390-86 & 0720-25)

• Recommendation:

  Adopt Resolution 2022-75 to accept and appropriate $812,262 in Clean California Local Grant funds.

RESOLUTION NO. 2022-68 AND SA-22-83 APPROVING AND ADOPTING THE AMENDMENTS TO CITY OF IMPERIAL BEACH INVESTMENT POLICY AND DELEGATING THE CITY TREASURER THE AUTHORITY TO INVEST AND REINVEST. (0350-95 & 0418-95)

• Recommendation:

  Approve and adopt Resolution No. 2022-68 by the City Council and SA-22-83 by the Successor Agency authorizing the amendments to the City of Imperial Beach Investment Policy and delegating to the City Treasurer the authority to invest and reinvest the City’s financial assets.

SECOND READING AND ADOPTION OF ORDINANCE NO. 2022-1218 APPROVING AMENDMENT TO THE RETIREMENT CONTRACT BETWEEN THE CALIFORNIA PUBLIC EMPLOYEES’ RETIREMENT SYSTEM (CalPERS) TO INCLUDE COST SHARING FOR CLASSIC GROUPS (0520-70)

• Recommendation:

  Conduct the second reading, waive further reading and adopt Ordinance No. 2022-1218.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF IMPERIAL BEACH, CALIFORNIA, CONTINUING THE PROCLAMATION OF A STATE OF AN ONGOING LOCAL EMERGENCY RELATED TO COVID-19. (0210-25)

• Recommendation:

  Approve Resolution No. 2022-76.

RAISING CANE’S (APPLICANT); CP-21-0004, CUP-21-0004, DRC-21-0017, SPR-21-0018, AND CEQA CLASS 32 EXEMPTION FOR A NEW DRIVE-THROUGH RAISING CANE’S RESTAURANT AND OUTDOOR PATIO AT 900 PALM AVE (APN 626-212-36-00). USE-21-0054. (0600-20)

• Recommendation:

  That the City Council adopt Resolution 2022-73, approving Regular Coastal Permit (CP-21-0004), Conditional Use Permit (CUP-21-0004), Design Review Case (DRC-21-0017), Site Plan Review (SPR-21-0018), and a categorical exemption pursuant to the California Environmental Quality Act (CEQA) Guidelines Section 15332 Class 32 (In-fill Development Projects) proposing to demolish an existing building and construct a new Raising Cane’s restaurant with a drive-through facility at 900 Palm Ave (APN 626-212-36-00) in the C/MU-1 (General Commercial and Mixed Use) Zone subject to the conditions as specified in the attached resolution.

• Recommendation:

  That the City Council adopt Resolution 2022-74, approving Regular Coastal Development Permit (CP-22-0015), Conditional Use Permit (CUP-22-0012), Design Review Case (DRC-22-0028), Site Plan Review (SPR-22-0023) and Categorical Exemption pursuant to California Environmental Quality Act (CEQA) Guidelines Section 15303 Class 3e (New Construction or Conversion of Small Structures) for the proposed attached 527 square foot exterior covered patio addition to the existing IB Forum restaurant at 1079 Seacoast Drive (APN 625-392-23-00) in the C/MU-2 (Seacoast Commercial & Mixed-Use) Zone.

  Staff recommends the City Council receive and file the investment update report from Chandler Asset Management.

REPORT ON THE BAYSHORE BIKEWAY RESILIENCY PROJECT – CREATION OF A COASTAL RESILIENCE CORRIDOR IN IMPERIAL BEACH. (0680-20)

• Recommendation:

  That the City Council receive the report and presentation from staff on the Bayshore Bikeway Resiliency Project – Creation of a Coastal Resilience Corridor in Imperial Beach and provide staff with a recommendation on the preferred options for the three segments and comments on the proposed project concepts and design.

RESOLUTION NO. 2022-70 ADOPTING THE LOCAL ROADWAY SAFETY PLAN. (0750-90)

• Recommendation:
  1. Approve Resolution 2022-70 adopting the Local Roadway Safety Plan
  2. Direct staff to develop the short-term improvements and pursue grant funding

CONSIDERATION OF RESOLUTION NO. 2022-72 APPROVING POLICY NO. 618 A CITY COUNCIL POLICY- MURALS ON PUBLIC PROPERTY. (0410-95)

• Recommendation:

  Staff recommends the City Council consider approving Resolution No. 2022-72 approving City Council Policy number 618 for murals on public property.

10.e

UPDATE ON ACTIONS TAKEN TO ADDRESS THE CONCERNS RAISED BY THE RESIDENTS OF THE MIRAMAR MOBILE HOME PARK IN IMPERIAL BEACH. (0660-30)

• Recommendation:

  Staff recommends the City Council receive the report and provide direction to the City Manager to proceed with the current effort or to explore other options.
